Liberals all tutting about the Supreme Court lacking “legitimacy”. And…? I mean, are you going to decide ‘cause they’re illegitimate states don’t have to follow their rulings? How’d that work back with Brown v. Board?

  2. sunnyroom said: Weird situation because, on the one hand, the Supreme Court is among the most undemocratic institutions we’ve got. But on the other hand, direct democratic control over the observation of individual rights = bad. very bad. The one thing the Supreme Court has historically seemed good for is protecting rights. Suddenly striking a lot of people that it does so essentially arbitrarily, by the personal preference of the justices, but it always has, and that has always sucked.
