The other half of the great conservative drive to undo the 70s, legal-system-wise is business regulation, incl. civil rights and antidiscrimination law.

Of course all along that was being hollowed out by judicial and bureaucratic discretion (you see occasional complaints that the Americans With Disabilities Act positions itself as a “civil rights” matter, but passed in 1990, has been implemented with much more deference to other interests than the ‘70s classics) and the current businesssphere is coevolved with it – which means the business theatre of the “war on woke” might come into play, conservatives not liking how business has adapted to certain pressures and favoring alternatives
